Survey Smarter

Terms of use

The terms for using the Survey Smarter website, account and current professional surveying application.

Updated 5 October 2026

1. About these terms

These terms apply to the Survey Smarter website, account features and Survey Smarter application. The service is operated by DAMPSURVEY PRO LTD, company number 17029975. It is registered in england and wales at 3rd Floor, 86–90 Paul Street, London EC2A 4NE.

By using the website or application you agree to the version of these terms presented to you at that time. These terms do not apply retrospectively to conduct before they were made available. If you use Survey Smarter for an employer or organisation, you confirm that you are authorised to act for it.

2. The service and your licence

Survey Smarter is professional surveying and report-production software. Home Survey Level 2 is the currently available workflow. Features described as planned, in development or coming soon are not part of the current service.

We grant you a limited, non-exclusive, non-transferable and revocable licence to use the current service for lawful professional and internal business purposes, subject to these terms. You may produce reports for your clients in the ordinary course of your surveying work.

3. Professional responsibility

Survey Smarter supports inspection, evidence recording and report preparation. It does not inspect a property, decide what is material, replace professional judgement or guarantee that a report is complete or suitable for a particular purpose.

You remain responsible for your competence, qualifications, scope of instruction, inspection, findings, ratings, wording, quality checks, legal and professional duties, and the report supplied to your client. You must review every output before issue. Survey Smarter is not approved or endorsed by RICS.

4. Your inputs and client rights

You must have a lawful basis and all necessary permissions to enter names, addresses, photographs, survey observations and other information. You must respect confidentiality, privacy, intellectual-property and other rights belonging to clients, occupants and third parties.

Do not enter unlawful material, content you have no right to use, malware, or information unrelated to a legitimate surveying purpose. You are responsible for responding appropriately to your clients and other individuals whose information you control. See our Privacy notice for the distinction between account information and survey content.

5. Ownership of survey data

You or your organisation retain ownership of survey content you enter, subject to any rights belonging to clients or third parties. You grant us only the limited permission needed to host, copy, transmit, display and otherwise process that content to provide, secure, support and maintain the features you choose to use.

This permission does not allow us to sell your survey content or use it to advertise unrelated products. It ends when the relevant content is deleted from the service, except for copies that must temporarily remain for security, recovery, legal or technical reasons. Local copies on your devices are controlled by you and are not removed merely because a cloud or account copy is removed.

6. Accounts and security

Keep your sign-in details confidential, use a strong unique password, protect devices used for surveying, and tell us promptly if you suspect unauthorised access. You are responsible for activity carried out through your account unless the activity results from our failure to use reasonable care and skill.

An account is not required for device-only use. Signing in can copy selected written surveys between your devices. Account access does not automatically upload every survey, photograph or report.

7. Device storage, offline use and backups

Survey Smarter saves work locally in your browser so that the current application can be used offline. Browser data can be lost through device failure, browser clearing, removal of site data or loss of access to the device. You should maintain suitable device security and make regular encrypted backup files using the application’s backup feature.

We will use reasonable care and skill in providing the service, but local storage is partly controlled by your device and browser. Nothing in this section excludes responsibility that the law does not allow us to exclude.

8. Optional cloud copy

When signed in, you decide which written survey records to copy to your account. Photographs, thumbnails and archived Final PDF reports remain local unless you separately select Complete cloud copy for that survey. That choice copies Survey Smarter’s stored, optimised images, thumbnails and archived Final PDFs; it does not take or alter original files in your device’s photo library.

Pausing or changing the option affects future transfer activity and does not by itself erase copies already stored locally or remotely. You should check the status shown by the application before relying on a cloud copy.

9. Acceptable use

You must not misuse Survey Smarter. In particular, you must not:

  • attempt to access another user’s account, workspace or survey data;
  • circumvent access controls, probe security without written permission, or disrupt the service;
  • upload malicious code or use the service for unlawful, fraudulent or abusive activity;
  • reverse engineer the service except where applicable law expressly permits it; or
  • use automated activity that materially harms availability for others.

10. Availability and support

We aim to keep Survey Smarter available and to correct material faults, but we do not promise uninterrupted or error-free operation. Maintenance, updates, internet failure, browser or device limitations, and events outside reasonable control may affect access. Keep local and exported copies needed for business continuity.

For support, complaints or questions, contact jason@dampsurvey-pro.co.uk or telephone 0800 2888 728. We will consider the circumstances and respond within a reasonable time.

11. Suspension and ending access

We may proportionately restrict or suspend account or cloud features where reasonably necessary to address serious or repeated misuse, security risk, unlawful activity or material breach. Where appropriate, we will give notice and an opportunity to remedy the issue.

Where practicable and lawful, suspension will preserve access needed to read or export existing work. We will not deliberately remove device-only copies. Immediate action may be necessary where delay would expose people, data or the service to material harm.

12. Intellectual property

The software, interface, branding, templates and website content belong to us or our licensors. These terms do not transfer those rights to you. Your rights in your survey content are addressed separately above. You may not copy, sell or commercially exploit the software or website content except as these terms or the law allow.

13. Third-party links and separate products

Links may lead to third-party sites or to DampSurvey-Pro, RemedialPlan and AsbestosSurveyPro. Those are separate products or services with their own websites, accounts, subscriptions, data arrangements and terms. A link does not make their service part of Survey Smarter, and we are not responsible for an unrelated third-party site’s content or availability.

14. Planned subscription and trial

Paid billing and trial activation are not currently live. The planned Survey Smarter Professional offer is £99 per month with a seven-day trial requiring no payment card. Creating an account today does not start that trial and no subscription payment is taken through Survey Smarter.

Before paid subscriptions launch, separate subscription terms will disclose the final payment, renewal, cancellation and any applicable statutory information. This page does not create a paid subscription, refund policy or trial entitlement.

15. Liability and rights preserved by law

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of terms implied by law where exclusion is prohibited, or any other liability that cannot lawfully be excluded or limited.

Subject to those protections, each party remains responsible for loss that is a reasonably foreseeable result of its breach or failure to use reasonable care and skill. We are not responsible for professional decisions, report content or losses caused by inaccurate or unlawful information supplied by you. If you have statutory rights that apply despite your professional use, those rights are not affected.

16. Changes, governing law and complaints

We may update these terms to reflect service, legal or security changes. A new version applies from its stated date; it does not retrospectively change completed events. If a material change affects account use, we will take reasonable steps to draw it to your attention before it applies.

These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, but this does not deprive a consumer of mandatory protections or the right to bring proceedings in another UK jurisdiction where the law provides that right. Please raise complaints first through jason@dampsurvey-pro.co.uk or telephone 0800 2888 728 so we can try to resolve them.
